Take Down Policy

This Take Down Policy is in compliance with the Electronic Communications and Transactions Act 25 of 2002.

Overview

Telemedia respects the intellectual property rights of others and expects users of our services to do the same. In accordance with the Electronic Communications and Transactions Act, we have implemented procedures for receiving and responding to complaints alleging copyright infringement.

Filing a Take Down Notice

If you believe that content hosted on our infrastructure infringes your copyright, please send a written notification to our designated agent containing the following information:

  • A physical or electronic signature of the copyright owner or authorized agent
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, including URL or specific location
  • Your contact information (name, address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information in the notification is accurate

Response Time

Upon receipt of a valid take down notice, we will respond within 5 working days and take appropriate action, which may include removing or disabling access to the allegedly infringing content.

Counter-Notice

If you believe your content was wrongfully removed, you may submit a counter-notice containing:

  • Your physical or electronic signature
  • Identification of the material that was removed
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  • Your name, address, telephone number, and email address
  • Consent to jurisdiction of the South African courts

False Claims

Please note that under Section 77 of the Electronic Communications and Transactions Act, any person who knowingly makes a false statement in a take down notice may be liable for damages.
